Welcome to Ellaire Manchester. These Terms of Service ("Terms") govern your use of www.ellairemanchester.com (the "Site") and any purchase you make from us. Please read them carefully. By accessing the Site or placing an order, you agree to be bound by these Terms.

Throughout these Terms, "we", "us" and "our" refer to Ellaire Manchester, and "you" refers to the user or customer.

2. Eligibility

By using the Site you confirm that you are at least 16 years old and have the legal capacity to enter into a binding contract. If you are under 18, you may only use the Site with the involvement of a parent or guardian. You may not use our products or Site for any unlawful purpose.

3. Products, descriptions and images

We take care to describe and photograph our products accurately. However:

  • Colours may appear differently depending on your screen, settings and lighting conditions. Slight variation between the image and the item you receive is not a defect.
  • Measurements are approximate and may vary slightly between individual items and between production batches.
  • Product specifications, materials and packaging may be updated without notice.

All products are subject to availability. We reserve the right to modify, limit or discontinue any product at any time, and to limit the quantity of any item sold to any customer, household or order.

4. Prices and payment

  • All prices are displayed in British Pounds (GBP) and include applicable VAT.
  • Shipping is free on all orders. No handling, packaging or hidden fees are added at checkout.
  • We reserve the right to change prices at any time. Price changes do not affect orders already confirmed.
  • Payment is taken at the point of order. We accept the payment methods displayed at checkout. Your card details are processed by our payment providers; we do not store them.

Should an item be listed at an incorrect price due to a typographical, pricing or system error, we reserve the right to refuse or cancel any order placed at that price, whether or not the order has been confirmed and payment taken. Where payment has been taken, we will issue a full refund.

5. Orders and formation of contract

Placing an order constitutes an offer to purchase. You will receive an automatic order confirmation email — this acknowledges receipt of your order but does not constitute acceptance. A contract is formed only when we dispatch your order and send you a dispatch confirmation.

We reserve the right to refuse or cancel any order, at our discretion, including where:

  • The product is unavailable or out of stock
  • There is an error in the product description or price
  • We suspect fraudulent, abusive or unauthorised activity
  • The delivery address is outside our delivery area or is a PO box or forwarding address
  • The order appears to be placed by a reseller rather than an end consumer

Where we cancel an order after payment, you will receive a full refund.

6. Accuracy of your information

You agree to provide accurate, current and complete information when placing an order, including your name, delivery address, email address and payment details. You are responsible for keeping this information up to date. We are not liable for delayed or failed delivery caused by inaccurate or incomplete information you have supplied.

7. Shipping and delivery

Delivery is governed by our Shipping Policy, which forms part of these Terms. In summary: processing takes 1 – 3 business days, transit takes 5 – 9 business days, and total estimated delivery is 6 – 12 business days. The order cut-off is Friday at 15:00 (GMT); orders placed after that time enter processing on the following Monday.

Delivery estimates are estimates and not guaranteed delivery dates. Risk in the goods passes to you on delivery.

8. Returns and refunds

Returns and refunds are governed by our Refund Policy, which forms part of these Terms. In summary: you have 30 days from delivery to request a return, there is no restocking fee, and approved refunds are issued to the original payment method within 14 days of us receiving the returned item. Your statutory right of withdrawal within 14 days applies in addition to this policy.

9. Promotions, discount codes and gift cards

Promotional codes and offers are subject to their own terms, are valid only for the period stated, and may be withdrawn at any time. Unless expressly stated otherwise, codes cannot be combined, cannot be applied retrospectively to completed orders, and have no cash value. We reserve the right to cancel orders where a discount code has been obtained or used improperly.

10. Intellectual property

All content on the Site — including text, product descriptions, photography, graphics, logos, layout, design and the "Ellaire Manchester" name — is our property or licensed to us, and is protected by copyright, trade mark and other intellectual property laws.

You may view, download and print content for your own personal, non-commercial use. You may not reproduce, republish, distribute, modify, sell or exploit any part of the Site without our prior written permission.

11. Acceptable use

You agree not to use the Site:

  • For any unlawful purpose, or to solicit others to perform unlawful acts
  • To infringe our intellectual property rights or those of any third party
  • To harass, abuse, insult, defame, intimidate or discriminate against any person
  • To submit false or misleading information
  • To upload or transmit viruses, malware or any other malicious code
  • To scrape, harvest, crawl or otherwise collect data from the Site by automated means
  • To interfere with or circumvent the security features of the Site
  • To place orders using fraudulent, stolen or unauthorised payment details

We reserve the right to suspend or terminate your access to the Site for breach of these provisions.

12. User submissions

If you send us comments, suggestions, reviews, photographs or other material ("Submissions"), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and publish them in connection with our business. You confirm that your Submissions are your own, do not infringe third-party rights, and contain no unlawful, defamatory or abusive material. We are under no obligation to publish or respond to any Submission.

13. Third-party links and services

The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for their content, policies or practices. Any transaction you enter into with a third party is solely between you and that third party.

14. Disclaimer of warranties

The Site is provided on an "as is" and "as available" basis. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that any defects will be corrected. We make no warranty that the results obtained from use of the Site will be accurate or reliable.

Nothing in this section excludes or limits any warranty or right that cannot be excluded or limited under applicable consumer law.

15. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with your use of the Site or any product purchased from us shall not exceed the amount you paid for the relevant order.

We shall not be liable for any indirect, incidental, special or consequential loss, including loss of profit, loss of data or loss of opportunity.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Your statutory rights as a consumer are not affected.

16. Indemnity

You agree to indemnify and hold harmless Ellaire Manchester, its directors, employees, agents and suppliers from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

17. Force majeure

We are not liable for any failure or delay in performing our obligations where that failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, war, terrorism, civil unrest, epidemic or pandemic, government action, strikes, transport disruption, carrier failure, power outage or failure of telecommunications networks.

18. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of the remaining provisions.

19. Changes to these Terms

We may update these Terms at any time by posting a revised version on this page. The revised Terms take effect from the "Last updated" date shown above. It is your responsibility to review these Terms periodically. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The Terms in force at the time you place an order will govern that order.

20. Governing law and dispute resolution

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Netherlands, and the competent courts of the Netherlands shall have jurisdiction.

This does not deprive you of the protection afforded by mandatory provisions of the consumer law of the country in which you are habitually resident, and does not prevent you from bringing proceedings in the courts of that country where applicable law gives you that right.

If you are an EU consumer, you may also submit a complaint via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

21. Entire agreement

These Terms, together with our Privacy Policy, Shipping Policy and Refund Policy, constitute the entire agreement between you and Ellaire Manchester and supersede any prior agreements or understandings.
